Minnesota Judge Hears Motion to Intervene in Pro-Abortion Lawsuit

A Minnesota judge heard the Thomas More Society’s motion to intervene in a lawsuit brought against the state of Minnesota by an anonymous abortionist and a group most recently known for promoting mandated transgender health care. The hearing on January 24, 2020 in St. Paul was the latest action in Dr. Jane Doe, et al., v. State of Minnesota, et al.

Thomas More Society attorneys filed the motion in October 2019 with Minnesota District Court, seeking to intervene in the lawsuit to defend state laws regulating abortion against “meritless litigation.” The suit seeks to overturn Minnesota’s laws requiring a 24-hour waiting period before abortions, parental notification, and a requirement that fetal remains be buried or cremated rather than being treated like medical waste. The lawsuit also challenges the law requiring that all abortions be performed by a physician.

Minnesota Attorney General Keith Ellison, a known abortion-rights supporter, has publicly committed to “defend the laws of the state of Minnesota,” without regard for his own personal opinions. When Ellison failed to raise the state’s best legal defense, the Thomas More Society filed the Notice of Limited Intervention to Assert the Defense of Lack of Private Cause of Action on behalf of Pro-Life Action Ministries, Incorporated, and the Association for Government Accountability.

Two abortion workers who have concealed their identity and a church group that advocates abortion joined forces with Gender Justice and the Lawyering Project to sue Minnesota in the attempt to strip away the state’s protective oversight and eliminate abortion regulations.
